HPT Rental Terms

Payment Terms
An initial non refundable deposit will be secured at the time of booking confirmation. This can be paid by Visa or Master card only.
A second stage payment of € 300.00 per participant is also required upon receiving confirmation. This payment will be deducted from your nominated credit card (Eurocard/MasterCard, VISA) or can be paid in cash.
The remaining amount is due 33 days prior to motorcycle pickup. Your nominated credit card used at time of booking will typically be used for the second stage payment.

Special Payment Terms
Full balance of payment (including the deposit) will be collected at the time of confirmation if you have elected to process your booking in a currency different to Euro.

Motorcycle Pick Up Time
Daily from 09:00 am to 19:00 pm, after 16:00 p.m. half a day is charged

Motorcycle Drop Off Time
Daily until 19:00 pm, the drop off day is always charged as full day

Rental Terms

Rental Conditions:
These rental conditions are a constituent part of the contractual agreement between the supplier (Renter) and the customer (Hirer), governing the use of motorcycles. Rights to deviations, variations or supplemental provisions, which shall be valid only in writing, reserved.

1) Rental
a) The subject of the contractual agreement with the supplier is exclusively the temporary transfer of the reserved motorcycle(s). The Hirer himself/herself shall organise and conduct the trip of his/her own accord and shall use the motorcycle responsibly.

b) Unless otherwise stated, all prices shall include 300km per day with addition kilometres being charged at 30 cent per km. Third party liability insurance as well as fully comprehensive collision coverage insurance with the stipulated retention (own contribution). The fuel and operating costs are not included.

c) The retention (own contribution) stipulated in the fully comprehensive collision coverage insurance is to be left as a deposit for the motorcycle and can be paid in cash or by credit card (Eurocard/MasterCard, VISA).

d) Even if the motorcycle is returned before the agreed rental period has expired, the rental amount agreed in the contractual agreement is to be paid in full unless the motorcycle can be rented out to another party.

2) Payment and Cancellation
Defined by the General Terms and Conditions of Business of the supplier.

3) Obligations of Hirer
The Hirer shall use the motorcycle with due care and attention, observe the appropriate technical codes of practice and operating instructions as well as ensure road safety. The Hirer shall comply with legal requirements especially the provisions of road traffic regulations. The Hirer shall be liable to the payment of all administrative fees, fines and penalties that are attributed to his/her use of the motorcycle.

It shall be prohibited for the Hirer to:

a) Allow any other person than the authorized persons named in the rental agreement to use the motorcycle.

b) Allow such authorized persons to drive the motorcycle if they are banned from driving or if they do not possess a valid driver's licence or are incapable of driving.

c) Drive the motorcycle if he/she himself/herself is banned from driving or if he/she does not possess a valid driver's licence.

d) Use the motorcycle in a condition unsuitable for driving.

e) Use the motorcycle for commercial purposes.

f) Participate in motorcycling events of any kind, including the practice runs pertaining to such events.

g) Use the motorcycle off-road or on beaches.

h) Tamper with the speedometer. Any defects relating to the speedometer are to be reported to the supplier immediately.

i) Pawn or sell the motorcycle or dispose of the motorcycle or its parts, equipment, accessories and documents in any way that could infringe the rights of ownership of the Renter or infringe any other rights the Renter has on the motorcycle.

j) Park the rental motorcycle on the road during the night.

k) Use the motorcycle for trips abroad without the express agreement of the supplier in writing.

4) Obligations and Liability of the Renter
The renter shall hand over the motorcycle in a technically perfect, cleaned operational and road-safe condition with the seals on various components intact. The Hirer shall additionally receive the vehicle documents and tools. The Renter shall recognise and accept existing damage only if it is defined in writing in the rental agreement as part of the handover procedure. If, through no fault of the Hirer, a repair is necessary during the rental period in order to ensure operation or maintain roadworthiness of the motorcycle, the Hirer shall be entitled to commission an authorised dealer/workshop of the motorcycle manufacturer with the repair up to an amount of € 50.00. The original workshop bills are to be presented to the Renter. If the estimated repair costs exceed € 50.00, the Renter's consent must be obtained before proceeding with the repair. The liability of the Renter in the case of non-fulfilment and delay shall be limited to double the rental amount. Further claims, irrespective of whatever legal reason, are excluded unless the damage or loss to the Hirer is attributed to intent or gross negligence on the part of the Renter.

5) Liability of the Hirer for Damage
From the moment of transfer through to return of the motorcycle, the Hirer shall be liable to the Renter even for the slightest negligence/carelessness in terms of the demise (including the loss or confiscation) of the motorcycle as well as for all damage (such as accident or operational damage, damage as the result of improper use and damage that reduces the value of the motorcycle) that occurs beyond the scope of normal wear of the motorcycle during the rental period. In the case of damage to the rental motorcycle, the Hirer shall be liable for the costs of repair, invoicing and return actually incurred or defined by an expertise appraisal as well as for the costs of expertise, the reduction in technical and market value, loss of rental income during the repair period and for the replacement time in the case of total damage. A basic rate shall be paid per day to compensate for the loss of rental income. The burden of proof of lesser damage shall lie with the Hirer. The Hirer shall also be liable for additionally hired accessories.

6) Requirements in the Event of Accident or Any Other Damage
If damage or loss occurs, as well as in the event of damage or accident without the involvement of third parties, the Hirer shall be obliged to notify the Renter immediately by telephone. Towing and/or repair services are to be called in only after obtaining the consent of the supplier. The police must be notified immediately in the event of an accident. Evidence (witnesses, track marks, etc.) is to be secured, the personal data of those involved recorded and everything must be done that can contribute to correct and complete clarification of the sequence of events.
The Hirer shall not provide an admission of guilt and take any other action (payment, compensation) that could jeopardise the insurance cover.

7) Insurance Cover
a) The motorcycle has third party liability insurance covering damage to persons and property. The insurance sum amounts to € 50 million for third party damage. The amount in the case of damage to persons is limited to € 8 million per person.

b) The rental motorcycle is insured against damage, fire and theft. On acceptance of the motorcycle, the Hirer shall pay a deposit by credit card amounting to the retention (own contribution). This amount shall be reimbursed in full as soon as the motorcycle is returned undamaged to the Renter. Any damage to the motorcycle will be deducted from the deposit up to the amount of the retention (own contribution). The amount of the deposit/ retention may vary corresponding to the type of motorcycle and is defined under the "Deposit" section. The Hirer is expressly reminded that, despite fully comprehensive liability insurance, he/she is still liable for damage in the following cases:
- If he/she does not comply with the provisions of the contractual agreement as stipulated in clause 3
- Leaves the site of an accident he/she was involved in
- Causes damage intentionally, deliberately or through gross negligence
- Exceeds the agreed rental period contrary to the terms of the agreement

8) Return of Motorcycle
The motorcycle shall be returned with a full tank of petrol, clean, in faultless condition and without any externally visible deficiencies. The Hirer shall return the motorcycle in the same condition at the end of the rental period at the agreed place and time with all vehicle documents, tools and accessories. Should any tools or vehicle documents be missing, the Hirer shall be obliged to provide compensation amounting to € 100.00 for each time. The Hirer shall be obliged to pay the cleaning costs if the motorcycle is heavily soiled. If the designated return time is exceeded by more than 1 hour, the Hirer shall be liable to the payment of further rental per hour or per day as compensation. It shall be the reserve of the Hirer to prove that no or substantially lower damage was incurred by the supplier as the result of exceeding the rental period.

The Renter shall be entitled to rescind the rental agreement without prior notice if a compelling reason is known that would render continuation of the rental agreement unacceptable. Important reasons include in particular incorrect personal data of the Hirer, information on credit worthiness as well as serious infringement of the provisions of the contractual agreement. In the event of rescission without prior notice the rental motorcycle must be returned immediately, i.e. before the agreed rental period has elapsed. The Renter's right to claim for damages and compensation shall remain unaffected.

9) Separability Provisions
There are no collateral agreements or supplements to this rental agreement. All contractual agreements shall require the written form. This requirement also applies to the cancellation of this clause. Should a provision of this contractual agreement be or become invalid, the validity of the remaining provisions hereof shall in no way be affected. The contractual partners shall be obliged to replace the invalid provisions by stipulations which shall correspond as far as possible to the economic and/or commercial purpose of the agreement.


Terms and Conditions
General Terms and Conditions of Travel and Contractual Agreement

These General Terms and Conditions of the contractual agreement are a constituent part of the travel agreement between the supplier (Tour Operator) and the participant (Customer). Rights to deviations, variations or supplemental provisions, which shall be valid only in writing, reserved.

1. Contractual agreement
The contractual agreement shall not come into force before receiving written confirmation of the reservation. The prerequisite for participation is the signed liability waiver and the agreements for the use of rental motorcycles.

2. Down Payment – Final Payment
Together with the reservation confirmation, the customer will receive an invoice from the tour operator that is to be paid as follows:

• A down payment of € 300.00 per participant in the trip within 10 days after receiving the written confirmation.

• Final payment of the remaining amount at least 30 days prior to the start of the trip.

3. Services and Prices
Confirmation provided by the tour operator lists the services in detail and the total amount to be paid. The customer must provide additional payment for any individual services that he/she may require on conclusion of the contractual agreement or during the trip.

Any changes to the scheduled routes or overnight accommodation shall not be considered as a change to the offered services provided the changes, deviations or variations do not substantially alter the overall character of the booked tour.

Please bear in mind that a motorcycle tour demands a higher degree of participation and cooperation on your part than a conventional package tour. Many aspects are not completely predicable and cannot be fully planned in advance. We therefore hope you will appreciate any changes that may prove to be necessary.

If the hotel is not able to provide you with a single room despite confirmation, we will reimburse proportionally the additional amount paid to us.

4. Cancellation
The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:

The customer may cancel the tour in writing at any time before the start of the trip. The date of receipt of the cancellation by the tour operator shall be decisive. If the customer cancels a tour, the tour operator shall be entitled to demand cancellation costs amounting to the following:

• 10 % of the tour price from the time of down payment – 34 days prior to the start of the trip

• 30 % of the tour price 33 – 18 days prior to the start of the trip

• 50 % of the tour price 17 – 11 days prior to the start of the trip

• 100 % of the tour price less than 11 days prior to the start of the trip

The price will not be refunded if the customer does not arrive or arrives too late for the departure. If the customer misses the return flight or trip home, he/she himself/herself must organise the return journey. The customer shall not be entitled to any compensation from the tour operator.

In addition, you are at liability to prove to us a lower loss. Changes to scheduled dates, time and destinations are possible only by cancelling the existing agreement and subsequently booking a new tour. We recommend you take out a travel cancellation insurance.

5. Cancellation by the Tour Operator
The tour operator shall be entitled to cancel a trip up to 30 days before the start of the tour if the minimum number of 5 participants has not been booked. In this case, the customer shall be notified accordingly and the amounts already paid shall be reimbursed in full. No further claims or demands will be accepted.

If it is necessary to cancel a tour for reasons outside our control (force majeur, strikes, terror attacks, accidents, illness or injury of the tour guide, disasters or similar), the amounts already paid by the customer shall be reimbursed in full. No further claims or demands shall be accepted. We also reserve the right to terminate the tour prematurely for the aforementioned reasons. In such cases, we shall reimburse the amount equivalent to the remaining days of the tour (excluding any flight costs). No further claims or demands shall be accepted.

In the event of undisciplined, dangerous or disruptive behaviour as well as disregard of road traffic regulations, the tour operator and his authorised tour guides shall be entitled to exclude individual participants from the tour. In such cases, the rental motorcycle will be repossessed and the tour and/or rental costs will not be reimbursed.

6. Premature Termination of the Tour by the Customer
If, for any reason whatsoever, the customer terminates the tour prematurely, he/she shall not be entitled to reimbursement of outstanding services charged by the tour operator to his/her account. If it is necessary for the customer to prematurely terminate the tour for a compelling reason, e.g. due to illness or accident or serious illness or death of a close family relative etc. the tour operator shall assist as far as possible in organising the return trip home.

7. Complying with Rules and Regulations
Each participant himself/herself shall be responsible for complying with the respective road traffic regulations. Each participant rides at his own peril and shall be liable for any damage he/she may inflict on fellow tour participants or other road users. This requirement also applies when the participant is following the tour guide. Each participant must adapt his/her riding style in the interest of own safety.

8. Passport, Visas, Health Regulations and Driving Permits
The customer himself/herself shall be responsible for ensuring compliance with the passport, visa, health regulations and driving permits of the visited countries and for observance of the respective traffic regulations. If the customer cannot participate in or must prematurely terminate the tour due to failure to meet these requirements, the tour operator shall be exempt from any liability and shall not be obliged to refund payments to the customer.

There are currently no visa or vaccination requirements for EU citizens participating in our tours. The main requirement for all countries is a passport which is valid for at least 6 months and an internationally recognised motorcycle driving licence.

9. Liability
Within the framework of the duty of care of a professional businessman, the tour operator shall be responsible for thorough preparation of the tour, conscientious supervision and careful selection of the service providers as well as the correct execution of the agreed tour services corresponding to local customs.

Our liability shall be excluded or restricted in as far as the liability of a service provider for services is also excluded or restricted in compliance with legal requirements. In any case, our liability shall be restricted for whatever reason to double the amount of the tour price:

• in as far as damage incurred by the customer was caused neither deliberately nor through gross negligence on the part of the tour operator or

• in as far as we are only responsible for damage incurred by the customer due to the fault of a service provider.

Liability for delays shall be excluded.

In addition, the tour operator shall not be liable especially in the case of traffic accidents. In this form of adventure trip, each participant in the tour shall be responsible and liable for his/her actions, riding style and choice of route as well as for judging his/her own riding abilities even when following the tour guide.

Each tour participant therefore declares his/her agreement that the owner, organisers and representatives of the tour operator shall not be responsible for his/her personal safety and shall not be individually or collectively liable for events that occur in connection with the implementation or participation in the tour and which may lead to injury, death or damage to his/her property, family, heirs or legal successors.

10. Liability and Weather
Depending on the season and weather conditions, the tour operator reserves the right to change the route of the tour and therefore the accommodation if deemed necessary. We always take care to ensure the character of the tour is not altered and make every effort to provide a consistently high standard of services.

The tour dates are chosen such that the prevailing weather conditions in the respective regions are optimally suited to a motorcycle tour. The tour operator shall bear no responsibility for bad weather conditions that may occur. The customer shall not be entitled to claim reimbursement of the tour and rental costs for this reason.

11. Insurance
The tour operator recommends taking out a travel insurance covering cancellation costs, accident, illness, theft, liability and legal protection.

12. Complaints

In the eventuality of disruptions in services or damage, the tour participant is obliged to do everything within reason to keep the effects to a minimum. However, should you have cause to complain despite the great care and attention we devote to the planning and execution of these tours, we request you notify us without delay. You can lodge complaints during our normal hours of business. In addition, we request that you file any claims or demands against us within one month from the end date of the tour. After this period of time has elapsed, claims can be filed only if, through no fault of your own, you were prevented from keeping this deadline. Any guarantee claims are to be filed only by the customer himself/herself and cannot be ceded.

13. Miscellaneous
The invalidity of individual provisions of the travel agreement shall not result in the invalidity of the entire travel agreement. This stipulation also applies to these travel conditions. All past drafts of the travel conditions are replaced by these travel conditions and are therefore no longer legally binding.

14. Place of Jurisdiction
Both parties shall agree on Granada (Spain) as the place of jurisdiction.

FAQs

Q: Can the pillion sit out some legs in the chase vehicle?
A: Yes this is why we have a chase vehicle (apart from luggage transport).

Q: Is it compulsory to wear a helmet in the countries we will be travelling in?
A: Yes, in Morocco, Spain and Portugal it is compulsory to wear a helmet.

Q: Are vaccinations necessary in order to enter Morocco, Spain or Portugal?
A: No, special vaccinations are not necessary in order to enter any of the three countries.

Q: How much luggage may I bring?
A: As much as you need. The luggage is always transported in the chase vehicle and brought directly to our accommodation, where it will be waiting for you in your hotel room.

Q: What should I take with me?
A: - Passport:
For Morocco a passport that is valid for at least 6 months is necessary. For EU country participants, a passport is not necessary for Spain and Portugal, however it is recommended. For non EU participants, a passport is necessary for Spain and Portugal, same as all your trips.

- Driving License:
National motorbike driving license for the appropriate class is necessary and sufficient to take part in the tour.

- Medical Insurance Card:
The card must be valid in foreign countries and if possible also cover private hospitals.

- Motorbike-gear:
Motorbike protective gear, waterproof gear (easily storable combos are the best for transport).

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund Policy
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund Policy
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.

HPT Insurance

Insurance Cover

a) The motorcycle has third party liability insurance covering damage to persons and property. The insurance sum amounts to € 50 million for third party damage. The amount in the case of damage to persons is limited to € 8 million per person.

b) The rental motorcycle is insured against damage, fire and theft. On acceptance of the motorcycle, the Hirer shall pay a deposit by credit card amounting to the retention (own contribution). This amount shall be reimbursed in full as soon as the motorcycle is returned undamaged to the Renter. Any damage to the motorcycle will be deducted from the deposit up to the amount of the retention (own contribution). The amount of the deposit/ retention may vary corresponding to the type of motorcycle and is defined under the "Deposit" section. The Hirer is expressly reminded that, despite fully comprehensive liability insurance, he/she is still liable for damage in the following cases:

- If he/she does not comply with the provisions of the contractual agreement as stipulated in clause 3

- Leaves the site of an accident he/she was involved in

- Causes damage intentionally, deliberately or through gross negligence

- Exceeds the agreed rental period contrary to the terms of the agreement

The supplier recommends taking out a travel insurance covering cancellation costs, accident, illness, theft, liability and legal protection.
