GSH Rental Terms

Payment Terms
* An initial deposit is due upon confirmation of your booking and will be deducted from your nominated credit card. PLEASE NOTE: this deposit is non-refundable.
* A second stage payment of 25% will be deducted form your nominated credit card at the time of confirmation. This is non-refundable.
* The Balance Amount, shown in your payment breakdown, is due 28 days prior to the pick up date. This amount will also be collected using the nominated credit card provided upon submitting your booking. This Payment can be made by Master Card, Visa Card, PayPal or Bank transfer.
* A bond amount is due upon collection of your vehicle also (bond amount may vary depending on your type of vehicle and excess reduction policies). This amount is collected by way of Master Card, Visa Card, PayPal, Bank transfer. PLEASE NOTE: the bond amount is payable regardless of whether you have taken out an excess reduction policy or not.
* Please read the standard Terms of Agreement for the full Conditions of hire including these Payment Terms.

Special Payment Terms
* Full balance of payment (including the deposit) will be collected at the time of confirmation if you have elected to process your booking in a currency different to Euro.
*Full balance of payment (including the deposit) will also be collected at the time if confirmation, if you placed your booking within 28 days of your pick up date.

Cancellation Policy
The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:
Cancellation more than 64 days prior to the start of the rental period: 15% of the total costs.
Cancellation between 63-34 days prior to the start of the rental period: 50% of the total costs.
Cancellation 33-0 days prior to the start of the rental period: 100% of the total costs.

Terms&Conditions
The following Terms&Conditions apply to all services of the supplier.

A. Authorized Driver
The vehicle may be ridden only by an authorized rider named on the rental agreement. All authorized riders must satisfy our age
requirements and have a valid driver’s license. No other persons are authorized to ride the vehicle. The minimum age requirement for
all the vehicles is 25 years.

B. Lenders Responsibility & liability:
1. It is the responsibility of the lender to take care of the borrowed vehicle and ensure no damage occurs to the vehicle while in the lenders care.
2. In the event of any accident or injury I do not hold the supplier or any of its employees or agents liable for whatever.
3. The lender is the only person allowed to operate the vehicle and any damage caused by other parties will be the lenders responsibility
4. I understand that in the event of any damage being caused to the vehicle as a direct result of alcohol consumption that I will be solely responsible for all costs relating to the vehicle recovery and repair.
5. The lender agrees to assume financial responsibility up to the amount of € 1.0000,- in Spain/ Europe and € 1.500,- for travel in Morocco/Africa in case of damage to the motorcycle. The credit card information on file with the supplier will be used as guarantee of payment.
6. The lender is expressly reminded that, despite our insurance, he/she is still liable for damage/loss in the following cases:
A. If he/she does not comply with the provisions of the contractual agreement as stipulated in the rental agreement
B. Leaves the site of an accident he/she was involved in
C. Causes damage intentionally, deliberately or through gross negligence
D. Exceeds the agreed rental period contrary to the terms of the agreement
E. Loss of documents/registration papers. Riding off-road or on not official road.

C. Liability of the lender for damage:
From the moment of transfer through to return of the motorcycle, the lender is liable to the supplier for the slightest negligence/carelessness in terms of the demise (including the loss or confiscation) of the motorcycle as well as for all damage (such as accident or operational damage, damage as the result of improper use and damage that reduces the value of the motorcycle) that occurs beyond the scope of normally use of the motorcycle during the rental period. In the case of damage to the rental motorcycle, the lender is liable for the costs of repair, invoicing and return actually incurred or defined by an expertise appraisal as well as for the costs of expertise, the reduction in technical and market value up to the amount of the damage deductible option chosen. The burden of proof of lesser damage shall lie with the lender.

D. Accidents and breakdown:
In the event of an accident involving other persons the lender must stay at the scene of the accident until the police arrive. A full
accident report sheet must be filled out by all parties involved and both copies should be kept and returned to the supplier's office. In the event of a breakdown the supplier should be informed according to our Accident Instructions provided with the motorcycle documents.

E. Required documents:
The lender must provide a valid driving license which qualifies them to operate the borrowed vehicle or an International license which qualifies them to operate the borrowed vehicle for riders with a license not issued within the EU an international permit is required by Spanish Law. The lenders passport will also be required at the time of rental. The supplier reserves the right to refuse rental should the lender fail to provide the required documents.

F. Fines and Tickets:
It is the lenders responsibility to pay all traffic fines and tickets received during the rental period. The supplier is obliged by law to provide the authorities with the lenders details in order to pursue road traffic offences.

G. Property:
The rental motorcycle shall remain the property of the supplier at all times. The lender must return the motorcycle on the agreed date and time and failure to do so will result in further charges being applied.

H. Privacy:
The supplier undertakes to keep your information confidential, and will only use it to offer relevant services related to your enquiry/booking. None of these details will be passed on to any third party organization . Credit card details we will keep in file securely two years after your last visit and all others details we keep in file securely.

Payment Conditions

Reservation conditions
After filling out our booking form. you will get a confirmation by the supplier containing all provided details and an estimation of costs.
After receiving the down-payment your reservation is definitive.
The supplier reserves the right to supply a replacement motorcycle if, due to unforeseen circumstances, the motorcycle booked is no longer available because of damage, mechanical breakdown etc.

Way of payment:
Master Card, Visa Card, PayPal, Bank transfer.
For Credit Card payment the supplier will charge an additional 1.5 % as administration fee.
For PayPal the supplier will charge an additional 4% as administration fee

Payment conditions:
The advance payment of the reservation is 25% of the total cost
The remaining part is due for payment 4 weeks before arrival.

Pick-up, Drop-off:
Airport pick-up or drop-off between 22.00-08.00 hrs. we charge extra € 25,- (approx. 22 Pounds).
The Bike must be returned to B&B Casa Don Carlos at the time agreed (see contract).
Standard Rental start at 09:00 and ends 18:00 hours or as agreed in the contract.
The supplier will check the condition of the bike at the start and checked again upon return.
After airport Pick-up The supplier you get a technical briefing at the Casa Don Carlos.

Pick Up/ Drop Off Instructions
a. Depending your arrival terminal 1, 2 or 3 of Malaga Airport, please walk to the first floor of Terminal 2, the Departure concourse. Walk across the road to the P1 car park entrance and Tobacco shop (meeting point) and one of the supplier staffs will be standing there. On the odd occasion the supplier pops into the terminal to check the screens or, if for any reason, no one is there, then just wait at the Tobacco shop and the supplier will turn up. (If you are delayed please text as soon as you land just to keep us in the picture). Or call the supplier.
b. For pick up or drop off between 22.00-08.00 hrs. The supplier charges an extra 25,- Euro.

Holiday Insurance
For U.K. clients: Please remember to bring holiday insurance that covers you for riding a motorcycle and the new E111 card available here.

International Driving Permits
U.S. and not EU citizens visiting Spain who want to drive in Spain must obtain an international driving permit prior to their arrival in Spain.

The rates on this website are often heavily discounted. This is due to our negotiated rates and bulk buying power. On very rare occasions, a rate may be displayed incorrectly due to our, or a vehicle supplier's error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.

Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund Policy
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.
